Understand Copyright (Finally!): Things Every School Staff Member Must Know and Change (September 18, 2018)
The day-to-day world of copyright compliance in schools is one of the more worrisome subjects for school lawyers. Everyone in education has learned about the basics of copyright at some point or another. You've heard the terms "fair use" and "cease and desist." However, complicated laws combined with ease of access to copyrighted materials makes full oversight nearly impossible. And the same technology that makes it incredibly easy to violate copyright laws also makes it more likely that the holder of the copyright can discover the violation and seek damages if they desire to do so. This presentation will cover the fundamentals and use that background to help school staff members create useful policy, practices, and compliance structures. BTW, you can totally steal the slides!
Personnel: What Schools Would Do If KSB Ruled the World (NOvember 6, 2018)
"But we've always done it this way," is one phrase that makes a school lawyer’s blood run cold in the middle of a personnel matter. When school administrators fail to comply with the personnel statutes, it is almost always rooted in a failure to refresh on the basics or reliance on shared "wisdom." Too often, personnel cases which should be simple are made way more complex by a missed deadline, accidental failure to evaluate, or any number of pitfalls we see every year. Even more importantly, teachers who could have their careers saved all too often flounder because the principal is not clear about what the teacher needs to do to improve instructional performance. This presentation will start with the legal framework and work through "hypothetical" scenarios with practical lessons used to build personnel processes that work.
Title IX: Are You My Coordinator? (February 12, 2019)
Our aim here is simple. This presentation is structured to meet the legal requirement for ongoing training for Title IX coordinators, but it will do so through the lens of providing all school staff members (especially administrators) with the training they need to ensure compliance. As the courts continue to evolve Title IX's obligations, the federal Department of Education continues to roll back existing "guidance." This presentation will bring everyone up to speed on your ongoing obligations and emerging issues in the world of Title IX.
Student Discipline: No, Seriously, You Need This (March 19, 2019)
Let's be honest--you either admit that you need a refresher on the laws relating to student discipline, or you're relying too much on past practice. Student discipline is perhaps the most susceptible area of school law in Nebraska when it comes to simple mistakes in carrying out lawful consequences. Unfortunately, these are almost always avoidable by letting go of the notion that your experience necessarily means you know how to do it right. This presentation will cover the statutory timelines and requirements before turning to real cases and "hypotheticals" to analyze 21st Century issues most of you will see to start 2018-19. You're in charge of the "should," but we'll help make sure you feel more confident in the "can" or "can't."
